Terms And Conditions Of Sale – Winery Experiences

1. General Information

These Terms and Conditions govern the sale of wine tourism experiences via the website
www.fattoriasanmichele.it (hereinafter, the “Site”), managed by:

The booking system is provided by the Divinea S.r.l. platform (www.divinea.com), however the
contract is considered to be concluded between the customer and Fattoria San Michele a Torri, the direct provider of the services offered.

2. Description of Services

Through the Site, users may book wine-related experiences such as tastings, guided tours, events, and related activities at our estate or with selected partners.

3. Prices

All prices shown on the Site include 10% VAT, unless otherwise specified. Travel agencies or B2B clients with active commercial agreements are entitled to a commission on the price excluding VAT, as agreed upon separately.

4. Bookings

Bookings are made via the online system provided by Divinea S.r.l. and are considered confirmed only upon receipt of the confirmation email. Customers are responsible for verifying the accuracy of their data before completing the booking and for promptly informing us of any allergies, intolerances, dietary restrictions, or any other information relevant to the proper delivery of the service.

Fattoria San Michele a Torri shall not be held liable for any discrepancy in the service provided due to the customer’s failure to communicate such essential information at the time of booking.

5. Payments

Payment must be made online at the time of booking, using the payment methods available in the Divinea system (credit card). Agencies with B2B agreements will receive an invoice in accordance with the terms of their collaboration agreement. If the customer requires an invoice, they must explicitly request it at the time of purchase, whether the experience is for themselves or as a gift to third parties.

6. Cancellation Policy

Unless otherwise specified in the experience description:

  • Free cancellation up to 48 hours before the scheduled start time.
  • Cancellations between 47 and 24 hours before the experience: 50% penalty.
  • Cancellations within 24 hours or no-shows: 100% penalty.


Late arrivals will not entitle guests to any discount or refund.

Any exceptions will be clearly indicated in the experience description or handled
directly by staff.

7. Consumer Rights (B2C only)

In accordance with Article 59 of the Italian Consumer Code (Legislative Decree 206/2005), the right of withdrawal does not apply to contracts for the provision of leisure services with a specific date or time period of execution.

8. Liability

Fattoria San Michele a Torri undertakes to provide experiences as described. However, we are not liable for cancellations due to force majeure (e.g., bad weather, health emergencies, unexpected logistical issues). In such cases, clients will be offered a rescheduling or refund, depending on the situation. 

Please note that guests under the age of 18 are not permitted to consume wine or alcohol, in accordance with applicable regulations. During the tastings, they will be offered water or grape juice instead.

9. Prices

All prices on our site are intended per person and expressed in Euro (€).
Payments will be charged in Euro (€).

10. Policy for Private Events and Groups Over 20 People

For requests involving private events, celebrations, exclusive tours, buyouts, or groups of more than 20 people, the terms and cancellation policy do not follow the standard Terms & Conditions available online.

tailored quote. We’ll be happy to design a custom-made experience for you.

A personalized proposal will be sent by email and will include:

    • Services included
    • Pricing
    • Payment terms
    • Cancellation policy and applicable penalties
    • Any specific contractual clauses
  • The proposal becomes contractually binding only upon written acceptance by the client (via email or signed digitally/in paper form).
  • The conditions outlined in the custom proposal shall override any general terms published online.

11. Disclaimer

In line with our safety standards, we kindly ask guests to inform us of any food allergies or intolerances at the time of booking, to ensure we can tailor the experience accordingly.

Due to the geological nature of the estate, some experiences may not be fully accessible to guests with mobility disabilities. For any assistance or specific needs, please contact us in advance at fattoria@fattoriasanmichele.it.

Please note that our wines, especially aged vintages and reserves, are produced in limited quantities due to our fully organic and seasonal production methods. Therefore, certain tastings may involve substitutions if specific bottles are no longer available. We will do our best to notify guests in advance should this occur.

12. Reference to Divinea.com Terms and Conditions

For all matters not explicitly governed by these Terms and Conditions, reference is made to the general terms and conditions of use and booking of the Divinea.com platform, which provides the integrated booking system on our Site. Online bookings are considered complete and binding only upon express acceptance of both these Terms and Conditions by Fattoria San Michele a Torri and the Terms and Conditions of Divinea S.r.l., available at:

Acceptance occurs by ticking the required checkbox during the checkout process.

13. Privacy

The processing of personal data is carried out in full compliance with EU Regulation 2016/679 (GDPR) and applicable Italian legislation.

During booking and website interaction, personal data will be processed by:

  1. Fattoria San Michele a Torri, as Data Controller, for purposes related to the management of bookings, the provision of purchased services, customer service, and, if consent is given, marketing and promotional communications.

By using the site and completing the booking, the user declares to have read and accepted
both privacy policies and the related data processing practices.

14. Governing Law and Jurisdiction

These Terms and Conditions are governed by Italian law. For disputes with consumers, the competent court is that of the consumer’s place of residence or domicile in Italy. For all other cases or B2B relationships, the exclusive jurisdiction is that of the Court of Florence.
