Art. 1 - Object

These General Conditions of Sale (hereafter referred to as G.C.S.) regard the sale of products via internet on the website www.fattoriasanmichele.it belonging to Fattoria San Michele a Torri s.r.l. with head offices in Scandicci, Via San Michele, 36, and registered on the Florence Companies Register No. 397597 (REA), Tax and Vat Code number 03899450484.

The G.C.S. apply to the following:

The Sellor: Fattoria San Michele a Torri s.r.l. , as identified above;

The Buyer: the person identified by the data inserted at the moment of compilation and transmittance on-line of the purchase order, with the contemporary acceptance of these General Conditions of Sale (hereafter referred to as the "Customer").

The law forbids the use of false and/or invented, and/or immaginary names in the on-line order procedures and in all further communications. Fattoria San Michele a Torri s.r.l. reserves the right to denounce any violations or abuse to the competent authorities, in the interest of and in protection of the consumers and the general public as a whole.

In addition, the Customer relieves Fattoria San Michele a Torri s.r.l.of responsibility for any errors deriving from the issue of incorrect fiscal documents caused by inexact or incomplete data supplied by the Customer, given that the latter alone is responsible for the correct data being submitted.

These G.C.S. relate to the sale of the products listed on the website of Fattoria San Michele a Torri s.r.l.. The Sellor company reserves the right to modify these G.C.S. at any time, informing the Customer thereof through its website.

Art. 2 - Sales on-line

By on-line sales contract we intend the contract with the on-line shop which has as its oblect the sale of "Products" stipulated between Fattoria San Michele a Torri s.r.l. and the Customer within a mail order system which utilises internet and the relative technology. Therefore, such contracts shall be concluded directly through the access by the Customer to the website www.fattoriasanmichele.it, where, following the steps indicated therein , the Customer is able to conclude the contract for the purchase of the Product.

The website gives contains a technical description of each of the products offered for sale, explaining the principal characteristics of the product.

It should be noted that the images presented together wuith the technical descriptions are for illustrative purposes only and may not always be exactly representative of the characteristics of the product.

Art. 3 - Prices

The Customer may buy only those products offered for sale on our website, at the price indicated therein and following the procedures indicated on our website. Confirmation of the correct receipt of the purchse order shall be confirmed via e-mail to the address supplied by the Customer. The order confirmation shall specify the time and date of the fulfilment of the order, together with a "Customer order number" to be used in any subsequent correspondence with Fattoria San Michele a Torri s.r.l. The order confirmation shall contain all of the data submitted by the Customer, who shall be responsible for checking the correctness of said data and for promptly communicating eventual corrections thereto.

The Company reserves the right, prior to the shipment of the order, to request further details from the Customer via e-mail regarding the order made.

The price lists are subject to variation. Fattoria San Michele a Torri s.r.l. shall update its website to indicate new prices.

Eventual errors in the publication of prices do not imply the automatic acceptance of purchase orders and shipment of goods by Fattoria San Michele a Torri s.r.l. In such cases the transactions via credit card shall not be concluded and, in the case of transactions via cash on delivery or other methods of payment, the Customer shall be informed in order to verify his acceptance of the correct prices to be paid.

At the Customer's express request, Fattoria San Michele a Torri s.r.l. shall issue an invoice for the goods shipped and send this to the Customer. The invoice shall be based on the data supplied by the Customer at the time of order. Once the invoice has been issued it shall no longer be possible to change any of the data contained therein.

Art. 4 - Product availability

In the event of a product becoming unavailable at our warehouse directly after the customer has submitted a purchase order, Fattoria San Michele a Torri s.r.l. shall inform the customer immediately via e-mil to the order address, and the purchase transaction shall be cancelled.

Fattoria San Michele a Torri s.r.l. does not accept any contractual or non-contractual obligation for the non-fulfilment of the purchase order.

Art. 5 - Acceptance of the General Conditions of Sale

The Customer, in submitting a purchase order by e-mail, expresses his unconditional acceptance of the GCS described herein, and he undertakes to comply with such in his dealings with Fattoria San Michele a Torri s.r.l., declaring that he has read and accepted all of the information given to him, and has taken note of the fact that Fattoria San Michele a Torri s.r.l. is not bound to any other conditions unless previously agreed in writing.

Art. 6 - Method of Payment

The following methods of payment only may be used by the Customer to pay for the products ordered and the relative shipping charges:

- Credit card : on the completion of the on-line transaction, the bank shall authorise payment only for the amount payable relative to the order made. This sum shall not be charged to the Customer's credit card until Fattoria San Michele a Torri s.r.l. fulfills the order.

In the event of the cancellation of the order by the Customer, following payment, Fattoria San Michele a Torri s.r.l. shall instruct the bank to reimburse the Customer by crediting his card.

The Customer must be the titleholder of the credit card, which must be valid at the date in which the on-line purchase order is made.

At no point whatsoever throughout the entire purchase procedure does Fattoria San Michele a Torri s.r.l. have access to information relatve to the Customer's credit card. This iformation id transmitted directly, via protected connection, to the website of the bank handling the transaction. The credit card data shall not be recorded in any of Fattoria San Michele a Torri s.r.l.'s computer records. Fattoria San Michele a Torri s.r.l. is in no way responsible for eventual fraudulent or other improper use of the credit card on the part of third parties.

- Bank transfer : the Customer shall transfer the amount indicated in the order, inclusive of delivery charges, to the bank indicated in the order confirmation received via e-mail and prior to the shipment of the goods concerned.

- Cash on delivery : The Customer shall pay the courier upon delivery of the goods.

Art. 7 - Shipment

The goods purchased shall be shipped by Fattoria San Michele a Torri s.r.l. to the address indicated by the Customer. Each shipment shall be made by express courier chosen by the Company. Where available, goods are generally passed to the courier within five working days from the date of acceptance of the purchase order, although Fattoria San Michele a Torri s.r.l. reserves the right to delay shipment beyond this period in the case of the events outwith their control.

Only complete orders shall be shipped.

The Customer must check the packages upon receipt, and notify the courier of any discrepancies, otherwise he shall forfeit all subsequent rights.

Art. 8 - Product guarantee

The products purchased on the website www.fattoriasanmichele.it are subject, where applicable, to the terms of the Italian Legislative Decree No. 24 of 2.2.20002 (G.U. No 57 of 8.3.2002) regulating sale contracts and guarantees regarding consumer goods, or otherwise to the relative conditions contained in the Italian Civil Code.

This guarantee shall apply to products which present defects which were not noticable at the moment of purchase.

The contamination of the wine by the cork does not give the Customer the right to return the product.

The above guarantee shall not be applicable in the event of negligence, or careless handling or storage of the product.

Eventual defects in the product must be communicated with the time forseen by law and via e-mail, fax or registered delivery letter.

The product must be returned to Fattoria San Michele a Torri s.r.l. in its original packaging together with the complete documentation received by the Customer at the time of purchase. Failure to do so shall prevent Fattoria San Michele a Torri s.r.l. from being able to replace the defective products.

In any case, the return of the product must be agreed in advance with Fattoria San Michele a Torri s.r.l., who must be informed of the method of return, with the name of the courier and any eventual tracking number. The goods returned travel at the Customer's risk until the moment in which they are delivered to Fattoria San Michele a Torri s.r.l.

Fattoria San Michele a Torri s.r.l. reserves the right to verify the existence of the defects declared by the Customer and to supply a replacement only after such control. Should these controls fail to evidence a defect of non conformity of the product, the Company reserves the right to charge the Customer for the cost of the controls carried out, together with the relative transport costs.

Art. 9 - Right of Withdrawal

The purchases made on the website www.fattoriasanmichele.it are subject to the Italian law regulating sales by correspondence. In the event that the Customer made a mistake in the order or received an article which he did not want, he has 10 (ten) days from the date of delivery time to exercise his right to withdraw from the purchase contract and return the goods received.

In accordance with article No. 64 onwards of DLT 206/2005, the Customer/consumer, ie a physical person acting in his own private interest and not for the purposes of any business, commercial, or professional activities, has the right to withdraw from a purchase contract for any motive whatsoever and consequently has the right to return the goods purchased and to obtain a refund.

The right of withdrawal is subject to the following conditions:

a) the right applies to goods in their entirety and not to single parts or components thereof;

b) in the event of gift or other sales promotions attached to the purchase, in which the purchase of a product is associated attached to another product which is sold for a ridiculous price (or which is free of charge), the right of withdrawal shall be exercised with the return of both products.

In order to exercise his right of withdrawal, the Customer, without the need for explanation and without incurring any penalty, must send, within 10 (ten) working days from the date of receipt of the goods, a communication in which he declares his intention to withdraw from the contract. This communication must be sent Fattoria San Michele a Torri s.r.l. and sent by registered delivery, with notification of receipt, addressed to Fattoria San Michele a Torri s.r.l., with head offices in Scandicci, Via San Michele, 36. At the same time, the Customer must make arrangements to return the goods to Fattoria San Michele a Torri s.r.l., using a courier of his choice, with a copy of the abovementioned registered letter. The goods must be returned whole in their original packaging, complete with all accessories. In accordance with the law, the shipping costs relative to the return must be paid by the Customer. In the case of more than one product relative to the same purchase orderfor which the Customer is exercising his right of withdrawal, these must be returned to Fattoria San Michele a Torri s.r.l. in a single shipment.

Fattoria San Michele a Torri s.r.l. takes no responsibility for any damages or theft/loss of goods returned by uninsured postage or shipment. Fattoria San Michele a Torri s.r.l. shall refund the price of the goods returned on the condition that the goods are received whole.

With the exception of the cost of any damages, Fattoria San Michele a Torri s.r.l. shall refund the entire sum paid by the Customer at the time of purchase of the goods within 30 days from the date in which it was informed of the Customer's intention to exercise his right of withdrawal, on condition that in the meantime the goods are being returned as specified above, by crediting the Customer's credit card.

The right of withdrawal becomes invalid in the following circumstances :

1. Absence of the original packaging;
2. Absence of all of the integral elements of the product (accessories, price tickets, labels etc.);
3. Damage to the product for reasons other than transport;
4. Consumption of the product.

In the event of the non validity of the right of withdrawal, Fattoria San Michele a Torri s.r.l. shall return the goods to the Customer and charge him with the shipping costs.

Art. 10 - Information and complaints

All explanations, information regarding customer services or eventual complaints may be requested or made to Fattoria San Michele a Torri s.r.l. at their head offices at the abovementioned address or via e-mail, at info fattoriasanmichele.it . The information contasined in these GCS and on the website for the single products are communicated as a whole in accorfdance with articles no. 52 and no. 53 of DLT 206/2005.
